This contract sets out the terms and conditions for the provision of technology infrastructure services by QNAX to any customer who places an order through the company's platform.

Activation and timelines
Services are activated after payment and registration validation. VPS and Cloud Server activate faster; Dedicated Servers depend on physical provisioning.
Self-managed environment
The customer is responsible for the system, applications, security and content of the server, except where additional management is specifically contracted.
Acceptable use
Illegal activity, attacks, malware, phishing, abusive spam and improper exploitation of network resources can result in immediate suspension.
Support conduct
The relationship with QNAX must remain respectful across all channels. Insults, threats or abusive conduct can result in immediate contract termination.
Cancellation
Cancellation can be requested at any time, but plans with a discount for an extended term have recalculation and a penalty under the contract rules.

Acceptance of this contract
By contracting any service offered by QNAX, including VPS, Cloud Server, Cloud Trader or Dedicated Servers, the customer declares that they have read this contract in full, understood its conditions and agree to the terms set out here.
Acceptance occurs electronically through confirmation in QNAX's ordering system, with full legal validity under applicable law.
Subject matter of this contract
QNAX provides computing infrastructure services under the IaaS model.
QNAX does not manage the content or applications installed by the customer, except where specifically contracted to do so.

Customer registration
To use the services, the customer must provide true and up-to-date information. False information may result in immediate suspension, contract cancellation and account blocking.

Right to refuse service
QNAX may refuse or cancel service delivery when it identifies operational, financial, legal or reputational risk.
This decision may be made without any need for public justification.

Service activation
Activation occurs after payment confirmation and registration validation. Timeframes may vary depending on resource availability.
- VPS / Cloud Server: 1 minute to 2 hours
- Cloud Trader: up to 24 hours
- Dedicated Server: up to 5 business days
Customer responsibility
The customer has administrative control of the server and is responsible for operating the environment, stored content and installed applications.
QNAX does not access server content, except when necessary for infrastructure maintenance.

Acceptable use policy
It is prohibited to use QNAX services for illegal or abusive activity.
- DDoS attacks, botnets, mass scanning and vulnerability exploitation
- Phishing, digital fraud, card cloning and scams
- Child pornography, sexual exploitation and illegal content
- Mass spam, malware distribution and abusive mining that compromises the network
Measures against abuse
If misuse of the infrastructure is identified, QNAX may notify the customer, grant a period to correct the issue, suspend the service or cancel the account.
In serious cases, such as cyberattacks, phishing, malware and fraud, suspension may be immediate.
Conduct in support channels
The customer agrees to maintain respectful, objective communication consistent with contractual good faith across all channels of relationship with QNAX, including the support desk, email, phone, WhatsApp, chat, social media, abuse channels, and technical, financial and sales support.
The following are considered incompatible with continuing the business relationship, without prejudice to other situations assessed by QNAX:
- Personal insults, name-calling, humiliation, offensive language or attacks on the honor, image, dignity or reputation of QNAX, its employees, operators, representatives, partners or service providers;
- False, unfounded or abusive accusations, especially those alleging bad faith, fraud, deliberate negligence, incompetence, dishonesty or unlawful conduct by QNAX or its team;
- Threats, intimidation, blackmail, coercion, harassment, stalking, abusive public exposure or attempts at undue pressure against the company or its employees;
- Repeated use of support channels in an aggressive, disrespectful or abusive manner incompatible with the technical, administrative or commercial purpose of support;
- Public disclosure of false, distorted or out-of-context information about QNAX, its services, team or infrastructure, when it causes or may cause reputational, legal, commercial or operational harm;
- Unjustified refusal to cooperate with the minimum technical information needed to review incidents, accompanied by abusive accusations against the team.
Submitting complaints, criticism, technical questions, requests for clarification or commercial disagreements is fully permitted, provided it is done respectfully, objectively and consistent with contractual good faith.
If conduct incompatible with this clause is identified, QNAX may, depending on the severity of the case and at its sole operational and legal discretion:
- Issue a warning to the customer;
- Limit support to formal, written channels;
- Close tickets that contain insults, threats or abusive language;
- Restrict support to the account holder or a formally designated representative;
- Temporarily suspend non-emergency support;
- Terminate or cancel the contractual relationship, with reasonable prior notice for data backup and retrieval, when applicable;
- Suspend or immediately terminate the services when the conduct represents legal, reputational, operational or security risk to QNAX, its team, its infrastructure or third parties.
In the event of termination for abusive conduct, QNAX may grant a period for backup, migration and retrieval of data, except when there is technical, legal, operational or security risk, an order from a competent authority, or a serious violation that justifies immediate action.
QNAX reserves the right to preserve records, tickets, messages, logs, recordings and other evidence related to support interactions, as well as to take appropriate administrative, civil and/or criminal action to protect its rights, its team, its reputation and its infrastructure.
This clause does not limit the customer's right to pursue appropriate legal remedies, contact consumer protection bodies, file legitimate complaints or exercise rights provided by law, provided this is done without abuse of right, bad faith, insults, threats or false accusations.
SLA and availability
QNAX guarantees 99.7% network availability. This SLA applies exclusively to network and hardware infrastructure.
The SLA does not cover issues arising from customer software, configuration errors, application vulnerabilities, external attacks or third-party failures.
To maintain platform stability, security and updates, QNAX performs periodic preventive maintenance that restarts nodes. This maintenance occurs at intervals of approximately 100 days and is preferably carried out between 00:30 and 05:00 (São Paulo time). Customer applications are recommended to be configured for automatic startup.
Backup and data protection
Responsibility for backups lies with the customer. QNAX may offer backup as an optional additional resource.
In the absence of a contracted backup service, QNAX is not liable for data loss.
Payments
Services are provided on a prepaid basis. Non-payment may result in suspension after 4 days past due and permanent data removal after 8 days past due.

Chargebacks and disputes
If the customer opens a dispute or chargeback with the payment provider, services may be suspended immediately and server access may be blocked.
QNAX may choose to refund the amount to avoid additional operational costs.
Term and cancellation
Services have a minimum term corresponding to the contracted period, and cancellation may be requested at any time.
For plans with a discount for a longer term, early cancellation results in the amount being recalculated without the discount, plus a penalty equivalent to one month's fee.
For VPS and Cloud Servers, a proportional calculation may apply along with a R$ 9.90 provisioning fee. Dedicated Servers have a minimum term of 30 days, with no proportional refund.
In addition to cancellation due to customer request, non-payment, misuse, operational risk, legal risk or violation of the Acceptable Use Policy, QNAX may terminate the contractual relationship in the event of a breach of good faith, loss of commercial trust, abusive conduct in support channels, insults to the team, threats, false accusations or significant reputational risk.
In these situations, QNAX may grant a reasonable period for backup and data migration, set the final date of service, and, where applicable, calculate any proportional credit due, in accordance with the commercial rules of the contracted plan.

QNAX keeps the technical records necessary for infrastructure operation in a secure environment.

Preservation of evidence
In the event of a police or judicial investigation, QNAX may preserve technical records, block server access and cooperate with competent authorities.
International infrastructure
QNAX's infrastructure may operate in data centers located in Brazil or abroad.
By contracting the services, the customer agrees that data and applications may be processed on international infrastructure.
Limitation of liability
QNAX's total liability for damages arising from service delivery is limited to the amount paid by the customer in the last 3 months of the contract.
QNAX is not liable for lost profits, lost revenue, data loss or interruptions caused by third parties.
Changes to this contract
QNAX may change this contract at any time. Changes take effect 30 days after publication on the website.
Governing law and jurisdiction
The courts of the Comarca de São Paulo, SP, Brazil, are elected to resolve disputes arising from this contract.
